Competitor patent survey
Monitor the innovative potential of your competitor and prevent infringement of third party IP rights
IP documents provide information about the creator or inventor and the owner of the IP rights. Thus, by performing an IP search you may discover or monitor the IP-related activity of other players or competitors, and identify potential business partners. In many cases, a correlation may be established between the number of patents a company is granted and its level of innovation.
In many cases, IP infringement may happen without intent. Note that even an innocent infringement can make someone subject to monetary damages. In general, as defendant in an IP rights infringement litigation, you may argue that infringement did not occur, or may attack the validity of the IP rights. However, before launching a new product performing a sound due diligence is mandatory.
If accused of infringement, you may start by analyzing your acts in relation to the corresponding IP rights in order to answer the question if there is in fact infringement. Then, an intense scrutiny of the validity of IP rights involved should also be considered.
